LIABILITY RELEASE

The Liability Release is also a part of the Tournament's Official Entry Form. The Team Captain must sign the Entry Form where indicated, acknowledging that he/she has discussed the Liability Release with all  team members, anglers, crew and guests and that all team members, anglers, crew and guests agree to the Liability Release.

This entry form, together with payment of appropriate entry fee, upon acceptance and approval, and subject to all the provisions and terms contained herein and in the 2008 Tournament Brochure and the separately published Tournament Rules, shall entitle the entrant to compete in the Puerto Los Cabos Billfish Classic Tournament (PLCBC).  Entrant agrees to be bound by and adhere to all tournament rules and regulations as published or amended. Any misrepresentation on this entry form, any signed release affidavits, signed weighmaster affidavits or violation of any Tournament rule will be cause for disqualification and forfeiture of any prize money and merchandise won in the tournament. The Tournament reserves the right to pursue such misrepresentations without regard to time limits.  By entering the PLCBC, all anglers, crews and guests, hereinafter referred to as Participant(s), agree to and understand that Tournament fishing and sportfishing in general have numerous obvious and non-obvious inherent risks that are always present in such an activity despite all safety precautions. Related injuries can be more severe than injuries or accidents in other activities. All participants acknowledge such risks and hereby freely assume same. It is expressly understood that all participants enter at their own risk and International Gamefish Tournaments (IGT) and Puerto Los Cabos (PLC), its owners and directors, sponsors, donors and all persons connected directly or indirectly with the operations of the tournament shall be exempt from any liabilities or libel, slander, loss, damage, negligence, harm, injury or death suffered by any participants, entrants, sportfishermen, their companions, boat captains, crew members, observers, boats and equipment which may occur during the tournament.  Any misrepresentation on the entry forms or otherwise may be cause for disqualification and forfeiture of any prize money and merchandise won in the tournament. Entrant and team members agree to accept as binding any and all decisions made by the Rules Committee of the (PLCBC). Entrant and team members agree to accept as binding any and all decisions made by IGT and the PLC in the administration and management of the (PLCBC).  IGT and PLC reserves the right to deny any entry form or reject any entry form once accepted and approved for any reason which in its sole judgment and discretion it deems proper.  IGT and PLC reserve the right to cancel the tournament for any reason.  In the event of any such cancellation, all entrants will be notified immediately and all monies paid by entrants shall be returned and neither party shall have liability to the other.  The tournament shall be closed to employees of IGT and PLC.  As further consideration of my team being permitted to enter the tournament, I do hereby irrevocably authorize you, your licensees, successors or assigns to print, publish, televise, video tape or otherwise use my team’s photographs, video tapes or any likeness of my team which may be recorded, transmitted, published or otherwise used on television, in print, or any other media during and after said tournament.  At the sole discretion of IGT and PLC, all entrants and their team members may be required to take a polygraph test administered by the tournament’s (PLCBC) independent polygraph contractor.  I and my team members agree to take such polygraph test, if asked, and abide by the results thereof. 

As team captain, I declare by my signature hereon, I have read, understood, accept and agree to the foregoing provisions.
